Age Restriction - You Must Be 18 Years of Age To Register and/or Use The BnLink.com Services BnLink.com Services are intended for individuals capable of meeting applicable age requirements and are not intended for participation by any persons under the age of 18. By accessing the BnLink.com site and/or using the BnLink.com Service, you certify that you are at least 18 (eighteen) years of age and you represent and warrant that you have the legal right, authority and capacity to enter into the BnLink.com Terms of Service Agreement and to abide by all of the terms and conditions of this Agreement. BnLink.com Member Registration To use certain features of the BnLink.com Service, you must register with BnLink.com on the registration form provided. You agree (a) to provide true, accurate, current and complete information about yourself as prompted by the Service's registration form, and (b) to maintain and promptly update the information you provide to keep it true, accurate, current and complete. If BnLink.com has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof). Our use of any personally identifying information you provide to us as part of the registration process is governed by the terms of our Privacy Policy. Membership Eligibility Membership in the Service is void where prohibited. You agree to submit accurate contact information and to keep your account updated as necessary with any changes to your information, including first name, last name, current residence, email address and payment options to keep your BnLink.com account in good standing. Membership is limited to one (1) BnLink.com member account. Multiple accounts will result in the termination of the account without notice. Privacy Policy BnLink.com is strongly committed to protecting BnLink.com members privacy. BnLink.com does not sell, trade or rent personal information to outside companies or 3rd parties. BnLink.com does not collect any personal information except the necessary information (See Registration above) to make payment. Any changes to this Privacy policy will be posted and dated. The current policy posted is in effect. User Submissions By submitting content to BnLink.com, you grant BnLink.com permission to use the information for public viewing. You are prohibited from submitting or transmitting to or from the site any of the following: Restrict or inhibit any other user from using and enjoying the Service. Post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, racist, profane or indecent information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any local, state, national or international law. Violation of the User Submission restrictions may result in the forfeiture of any and all payments, restriction of access and the use of the BnLink.com web site, without notice. BnLink.com, also reserves the right, in its sole discretion, to delete or remove member submissions from the BnLink.com site and to restrict, suspend or terminate access to all or part of the site, at any time for any reason without prior notice or liability. BnLink.com, may, but is not obligated to, monitor or review (a) any areas on the site where users submit or transmit User Submissions, and (b) the substance of any User Submissions. To the maximum extent permitted by law, BnLink.com will have no liability related to User Submissions arising under the laws of copyright, libel, privacy, obscenity, or otherwise. BnLink.com disclaims any and all liability with respect to the misuse, loss, modification, or unavailability of any User Submissions. To protect the interests of another user, a sponsor, merchant or other third party, or BnLink.com, the following actions are prohibited and will lead to immediate termination of a BnLink.com members account: The mechanical, manual or automated use of software or programs such as auto-surf, bots, any type of spam, and all other methods used to fraudulently manipulate, inflate or decrease statistics for your account or any other BnLink.com member account. Anti-Spam Policy BnLink.com, strictly prohibits the use of the BnLink.com Services in any manner associated with the transmission, distribution or delivery of any unsolicited bulk and/or unsolicited commercial e-mail, messages, comments, private messages, bulletins, or any other methods of communication ("Spam"). You may not use any BnLink.com Services to send or distribute Spam. Earnings The earnings chart and graphics used to outline the earning potential of the BnLink.com services, is not an explicit or assumed guarantee that you will achieve the same results, as results can vary. Member Payments Payments are paid with net 30 terms, upon reaching the minimal payment amount. These earnings are paid as long as the member is in good standing and the member has not participated in fraudulent activity. (See User Submissions) Currently, there are three payout vendors. Payments are made via Paypal, minus 3rd party transaction fees if any. Members are responsible for accurate contact information and any information that is incorrect or unverifiable, may result in the delay or inability to make payment. We will make a best effort attempt in contacting the member to update missing or inaccurate information and as a result, the payment(s) may be processed on the following payout schedule. Payouts will be paid upon meeting the minimum payment requirements. Member accounts are audited for accuracy and we reserve the right to withhold payment for any fraudulent activity. Use On An "As-Is" Basis You understand and agree that the BnLink.com Service is provided "AS-IS" and that BnLink.com assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store or retrieve any and all member information, submissions or content. Consent to Disclosure for Law Enforcement You acknowledge, consent and agree that BnLink.com may access, preserve, and disclose your account information and Content if required to do so by law or in a good faith effort or belief that such access preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the Terms of Service Agreement; (c) respond to claims that any Content violates the rights or copyrights of third-parties; or (d) protect the rights, property, or personal safety of BnLink.com, its users and the public. No Resale of Service or Data You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the BnLink.com Service. Indemnification You agree to indemnify, defend and hold BnLink.com, its agents, affiliates, subsidiaries, directors, officers, employees, and applicable 3rd parties (e.g. relevant advertisers, syndication partners, licensor's, licensees, consultants and contractors) (collectively "Indemnified Person(s)") harmless from and against any and all third party claims, liability, loss, and expense (including damage awards, settlement amounts, and reasonable legal fees), brought against any Indemnified Person(s), arising out of, related to or which may arise from Your use of the Program, the site(s), and/or Your breach of any term of this Agreement. Modification of Terms of Use Agreement BnLink.com reserves the right, at any time, to modify, alter or update these Terms of Service and members agree to be bound by such modifications, alterations or updates.
